Research On The Problem Of Civil "Execution Difficulty" In Our Country

Court execution is the last link in the judicial fairness and justice,it is related to the realization of the rights of the effective legal documents,to safeguard the legitimate rights and interests of the parties,to set up the judicial credibility and the judicial authority is of great significance.The issue of "implementation difficulties" has aroused high concern from all sectors of society,and the people reflect strong problems.Perform difficult problems and the existence,is the superposition of multiple factors interweave,concentrated expression of interaction between various contradictions,not only seriously affected the people's court's judicial authority,and damage the legitimate rights and interests of the masses of the people.The causes of "execution difficulties" are complicated,including the reasons of the parties themselves,the factors of the court,and the influence of external intervention,the lag of legislation and the unsound social credit system.It is a social problem that the implementation of the difficulty rises through a legal level.This paper is divided into three parts.The first part is an overview of civil execution and the definition of "difficult to execute",performance and harm,this paper expounds the definition of civil execution,the analysis of the definition of "difficult to execute",and summarizes the main forms and harms of the "law enforcement difficulty"."Difficult to execute" in the second part of the cause analysis,inductive formation problem of "difficult to execute" legislative lag,the court system of the main reason for the lack of internal reasons,the parties,the rule of law concept,etc.;The third part describes some effective countermeasures to solve the problem of "execution difficulty".
