In recent years,the trial live webcast in the United States and Britain and other developed countries.A new force suddenly rises,the judicial system has doubts on the network broadcast the trial practice,the trial webcast also twists and turns,in some cases to promote the development of the trial webcast,some cases also limit its development,which not only causes a game of judicial independence and media freedom of speech,but also the social public right to know and the right of privacy,conflict of right to a fair trial.How to carry out the trial live webcast is the information age the world justice system must be faced with problems.In this background,this paper points out that the trial webcast has great practical significance,studies the practice of our country's trial webcast,along with the progress of communication technology,it is becoming a new trend of China's judicial public trial the webcast,especially of the party since eighteen,the progress of the trial webcast quite quickly.At the same time,like the United States and Britain,China's court webcast is also playing such problems as value game.In addition,there are still "Chinese dilemma",such as lack of legislation,strong administrative dominance,low referee rate and insufficient technical support.The reasons for these difficulties are imbalance in regional economic and social development,low professionalization of judges,tendentiousness in media reports,public trust in the judiciary,and the nature of cases.Therefore,the following five aspects should be set out to improve the webcast of the court trial.First,we must improve the legislative norms,clarify the legal status of court webcast,standardize the scope of the court live webcast,live broadcast procedures,etc.at the same time,pay attention to the balance between different values and solve practical problems in practice.Second,deepen the judicial reform and vigorously promote professionalization of judges.Enhance the judicial ability of the judge by strengthening the court's quality certificate and the referee in the court.The judge's main position is established through the system of judge posts,the promotion of the professional ethics of judges,the attention of the judges' mental health and the standard supervision.Third,strengthen the consensus and effectively protect the media's right to freedom of the press.The media should standardize the time to publicize and report cases,guide the public opinion of the network,and form a benign interaction between the judiciary and the media.Fourth,actively publicizing the public's consciousness of modern rule of law.Fifth,based on the actual improvement of China public trial network,set a number of options to achieve precise push;additional demonstration trial video program,to promote the modern concept of the rule of law dissemination;add "public evaluation platform",enhance the enthusiasm of public participation;improve the cases of basic information.
