Virtual currency is the ramification of the development of the Internet Economy,and it is the new development of manifestation of the currency in the network background.It has played an irreplaceable role in promoting development of internet economy and financial innovation,and it is the representation of the activity of market.However,virtual currency also causes many social problems.Academic circles on its properties are difficult to define and there is a lot of controversy.The random of virtual currency issue and trading overflow destroys the normal virtual market,leading to more and more infringement.Besides,others take use of virtual currency to commit a crime such as money laundering.At present,our country related to the virtual currency legal norms on the whole present dispersed structure,although the normative documents have been produced but only in some notice of file the form,did not form a unified legal system.The legislation is incomplete now,resulting in no specialized regulatory authority to the virtual currency for effective supervision,supervision of unknown consequences is the result of regulatory vacuum,as lawbreakers brought before the machines,while in the virtual currency crime did not establish a specific punishment mechanism at the same time,the legitimate rights and interests of consumer also can not be protected.Therefore,it is necessary to perfect the legal regulation of virtual currency.The paper is divided into five chapters as follow: The first chapter is about introduction of the article.It includes research background,research significance,research status at home and abroad,the thinking of writing and innovation of this article.Chapter two defines the concept of virtual currency,and it will tell the difference between virtual currency,electronic money and virtual property.At the same time,it will indicate characteristics and category of virtual currency.Chapter three will indicate the current legislation of virtual currency.It respectively introduces the current legal regulation of virtual currency about the European Union,the United States,South Korea,Japan,and our country,and analysis characteristics of the current legal regulation of virtual currency in China.Chapter four will discuss detailedly legal issues concerning virtual currency in China.What is more,point out financial risk and legal risk.The last chapter will put forward to some measures to perfect virtual currency legal regulation.In the principle of regulating the development,currency security,interests of the citizens and the flexibility to coordinating,this paper will put forward some suggestions of legislation about virtual currency issue and circulation,and suggest establishing clear regulatory organization of virtual currency.
