Research On The Legal System Of Tourism Performance Assistants

With the promulgation and implementation of the new tourism law,the fulfillment of the concept of tour performance assistants was officially introduced to China,which is significant for realization of the right of performance and tangible interests of the tourists.The relevant legislation on the performance helper in our country,in contrast,is still in the initial stage,and the cognition of the law system mainly also derives from the foreign works.In light of that,it is necessary to look directly at the problem of the existing system to construct the system of tour perform helper with Chinese characteristics.Firstly,the corresponding legal definitions of tourism performance helper are defined in this paper,including the definition,scope and classification of the concept,and the analysis of the constitutive components.On this basis,the legal status of the tourism performance assistants is also analyzed hermeneutically,and its subject positioning presented and the legal relations with correlative parts are also presented,which lays the foundation for further responsibility determination.Secondly,the integration about legal liability regulation system of the tour performance assistants is performed through the analysis of the existing legislative system in our country.Finally,to improve the tour performance assistants system,the proposals including the definitude on connotation and denotation in the guiding cases and judicial interpretation,the improvement on responsibility of the relevant legislation of the legal liability regulation system,and the construction of the system of tour performance assistants with Chinese characteristics are presented in this paper.So that the tourists' legal privileges can be better protected and the legal claims of travel agency can be also considered,to promote rapid and healthy development of the tourism industry in our country.
