With the continuous development of science and technology,more and more job inventions have emerged in society,while paying attention to the quality and the effect of job invention,people also begin to pay attention to the distribution of benefits between the inventor and the company.Good job invention system can handle the interests balance between the position inventor and the company,and promote the invention enthusiasm of the post inventor.In the system of the job invention,the affirm to the right of invention and the reward system for the job invention are the two main contents.In this paper,we will from the perspective of the United States,Germany and Japan for reference system of job invention,with the basis of rights of ownership and reward of our invention distribution are studied,analyse the disadvantage of the existing system,and put forward the corresponding solutions,in order to provide help to the improvement of the system of the invention of the job.The affirm of the job invention is an important step in determining the attribution of the invention of the position and the relevant person's right and obligation.Our existing system of job invention belongs to the scope of job invention is too large and too broad,shortcomings and so on legal provision is too strong.It makes some situation don't have to be included in the service invention.the invention was forced into to the law,the inventor of the interests of the compulsory distribution with a blow to the enthusiasm of the inventor.Therefore,we should narrow the scope of the job invention and modify the "identification standard" of the existing job invention.On the basis of this,the article also suggests that the proposal can be made through "agreed priority" and reasonable control of legal application.On the other hand,as the core of our country's job invention system,the present job invention reward system has been gradually improved with the continuous modification and the gradual introduction of supporting system.But after a carefully study,i think job invention rewards system in China is still too fuzzy,the suitable for "agreed first" principle of market economy use more difficult problems.We can set the standard for the detailed position of the job invention award,raise the effectiveness of the "agreed priority" of the job invention award,and establish a reasonable and perfect evaluation system for the job invention.
