A Study On The Legal Issues Regarding Underlying Assets Valuation In Intellectual Property Securitization

With the development of knowledge economy and asset securitization,securitization of intellectual property rights arises at the historic moment.Intellectual property securitization as a branch of asset securitization,belong to a special kind of asset securitization,securitisation of intellectual property rights can produce a certain amount of cash flow.Intellectual property securitization as a financial innovation and intellectual property development with the combination of the new financing way,it not only will be the most competitive enterprise core assets,more will become the booster for the development of knowledge economy era.Predictable cash flow of the intellectual property rights,namely the underlying assets,it is the material base of the securitization transactions and risk source,the transaction is based around the assets,and the underlying asset evaluation value too high or too low may be important influence on intellectual property securitization transactions,intellectual property securitization transaction process is actually the underlying asset value evaluation and value realization process.Analysis and study of underlying asset assessment as one of the core content of intellectual property securitization,the success of the securitization of intellectual property rights,is of great significance,therefore,to avoid the legal risks of shortages of the traditional evaluation methods,improvement of underlying asset evaluation methods,and completes the basic value of the asset assessment of legal risk prevention and regulatory measures,the risk factors of asset securitization of intellectual property effectively is particularly important for the safety and stability of the whole financial market,plays a vital role.This paper USES literature,case analysis and inductive research method,through to the securitization of intellectual property rights in the underlying asset and the particularity of intellectual property value,basic assets analysis,traditional evaluation methods of legal issues underlying assets value assessment method in the analysis of the innovation,as well as the underlying assets assessment of legal risk prevention and supervision perfect measures,basis of intellectual property securitization asset appraisal legal problems are analyzed in this paper.
