Research On The System Of Public Lending Rights Of Digital Books In China

With the rapid development of economy and the ever-changing changes in science and technology,the types of books have become more and more abundant.Under the Internet environment,digital books have emerged as a result,and what has been rising is frequent infringement disputes in the digital book copyright field.Unlike traditional paper books,digital books have a variety of forms of information carriers.Unlike simple payment and download purchase methods,digital books still have a lot of borrowing methods.The rapid spread of the Internet leads to the author's rights being easily violated.Therefore,it is particularly important to find a reasonable win-win system to solve the protection of the rights of copyright owners.In the 18 th and 19 th centuries,European countries had already begun to explore the establishment of public lending rights system.The origin of the public lending right system was due to the conflict of interest between the public library's free public lending activities and the authors.The library's free lending behavior has brought losses to the author.Therefore,the author should receive corresponding compensation.At present,many countries in the world have established a very mature and complete system of public lending rights,and the legal provisions are also very complete.In the legislative system of our country,the public loan right has not been included in the law,but with the “Public Library Law” promulgated by China in 2017,the “Copyright Law” revised in 2010,and the “Information Network Communication Regulations” revised in 2013."The promulgation and implementation of these laws,China entered the new period of the study of public lending rights system.This article uses the methods of literature analysis and comparative analysis to elaborate the concept and characteristics of the digital book public lending right system,which leads to the necessity of setting up a digital book public lending right system in China.Based on the mature institutional system of public lending rights in the United Kingdom,combined with the current legislation and practice in China,comparative analysis has revealed that there are problems existing in the establishment of a digital book public lending right system in China.Afterwards,according to the existing problems,it puts forward the specific suggestions for the construction of the digital book public lending right system in China.The main conclusion of this paper is that China should establish a digital library public lending right system.First of all,we should improve the relevant legislation,formulate the "Regulations on the Management of Digital Works Public Lending Rights," and clarify the subject and object of rights and the compensation calculation rules.A Public Lending Adviser Group was set up to implement the public lending right system together with the library;secondly,the public interest of the library that applied the public lending right system was clearly defined so as to better carry out cultural communication.Exclude digital libraries between universities and prevent obstacles in academic exchanges.Select sample libraries for piloting to prepare for the follow-up to better implementation of the system;finally,we must coordinate in various ways to balance the different interests among various entities and promote the development of the digital library public lending right system on the basis of seeking common ground while reserving differences.
