Due to the increase number of private automobile in urban areas,residents in communities have to face the problem of parking.Real estate developers have the duty to build civil air defense projects combined with ground buildings.According to the principle of comprehensive usage in war or peace time,the civil air defense projects are used as parking space.This type of parking space is closely related to developers and residents.In Property Law,Civil Air Defense Law and Urban Real Estate Management Law,there are no specific regulations about the ownership of the special parking.It causes many disputes.The thesis tries to explain the ownership problem.This thesis mainly consists four parts.The first part gives a introduction of the concept,different theories,legislation and judicial cases about the ownership.The second part focuses on the theory of the parking owned by the state by discussing the air defense purpose,fee for not building defense projects,tax reduction and exemption and land ownership.The third part is about the theory of the parking owned by the residents.Do the residents share the construction cost of the parking? Dose the parking belong to the public service facilities? Do these factors decide the ownership of the parking?The forth part introduces how the developers fulfill their ownership of the parking.It suggests that the state should carry out registration of the parking,then the parking could be traded legally.
