Analysis To The Categories Of “Great Loss” In Crime Of Infringing Business Secrets

With the Coming of intellectual economy,governments have attached more and more importance to law protection of business secrets,both on scope and means.Recently in China,the crime of infringing business secrets has revealed two increasing tendencies,one is that the number of the crimes is growing quickly,the other is that the amount of money involved is raising substantially.Civil protection is not enough to meet the need of economy development.Using criminal means to safeguard market economy order has been recognized theoretically and practically.However,in juridical practice,there exit many problems on understanding and application of “Great loss”,which causes many debates without any effective countermeasures.According to different types of business secrets,the crime cases can be classified into business information infringement and technical information infringement,which categorical analysis can be adopted in handling such cases excluding those criminal law inapplicable.The proper use of categorical analysis can not only make for correct disposal with justice and efficiency,but also contribute to refinement of legislation and practice of standardization on the crime of infringing business secrets.
