Research On The Protection Of Costume Works

In daily life,infringement of costume works is very serious,it is a common phenomenon of plagiarism on the market,and the protection of costume works in the current laws and regulations do not have clear provisions,judgments in the protection of costume works is also controversial in the judgment practice.This paper argues that,costume works belong to a kind of practical works of art.Although China's copyright law does not provide for the protection of practical works of art,but practical works of art should belong to art works,access to copyright law protection.This article is divided into five chapters,using comparative analysis,literature research,case study and other methods to study,based on the current laws and regulations,and the third revision of the "People's Republic of China Copyright Law(revised draft manuscript)"(hereinafter referred to as "draft"),reference to the views of experts and scholars,relevant international conventions,foreign-related legislation and judicial cases.
