The Study Of Deliverying Legal Ducument Via Electronic Means During Civil Litigation

Considering the increasing prosperity of social economy,the increasing judicial awareness of the society,and the increasing number of cases of civil litigation with years,it makes the contradiction between the large number of civil cases and short of judicial staff.In the civil case trial,the service is related to the litigation rights and the smooth progress of the case.Currently from the judicial practice,there are general problems,such as short of service people,high cost of service and low efficiency service.However,with the development of information technology in the field of law has become increasingly significant.And the application of electronic services born in our civil law litigation had an important impact.In particular,China's newly revised "Civil Procedure Law" has legislated to determine the legal status of electronic service and supplemented by judicial interpretation again in 2015.Through the practice of electronic service in judicial trials in recent years,we believe that electronic service will be an important way to solve the problem of delivery.But also in the practice of the application process reveals that China's current electronic delivery legislation focuses on principle rather than detailed stipulation,the implementation of electronic delivery operation is not perfect and specific,and there are still some problems in operation.In view of this,this paper uses empirical research,comparative research,case analysis and other research methods,combined with their own practical work,discusses the current civil justice in the field of electronic service of the causes,the conceptual characteristics,the development trends and other theoretical basis.Combined with electronic service,this paper analyzes the problems and reasons of the electronic service in the field of legislation and judicial practice in the field of civil litigation in our Country,and then through studying the advanced experience of electronic service in some other countries and studying the development of electronic service and the practical experiences in domestic developed areas.Based on the theoretical research and the practice experiences,it makes some improvement suggestions from the theoretical consciousness,legislative adjustment,management mechanism and technical support for civil procedure electronic service in domestic,hoping to help solve the difficult service problem in civil procedure by electronic service and then achieving the judicial justice for the people in the near future,through our Country,the government,the legal profession and the community unremitting efforts.
