In 2012,electronic service in civil litigation was firstly provided in the modified civil procedure law.On February 2,2015,the Judicial Interpretation on Applying the Civil Procedure Law of the People's Republic of China Issued by the Supreme People's Court took into effect and further specified the regulations concerning electronic service in civil litigation.Because of its high speed and efficiency,electronic service has been appealing to the courts all over the country.However,there are only four provisions concerning the system of electronic service in civil litigation in the current laws and judicial interpretations,which causes a lot of problems in judicial practice and makes it unable to bring its role into full play.In China,the optimization of the system not only relies on the specific suggestions for improving the system itself,but also needs to regulate the construction of the court's information management and improve relevant supporting measures.To be specific,the system can be optimized by defining the scope of applying electronic service,regulating the storage and format of serving document,and improving the affirmation standard for completing electronic service.Meanwhile,the construction of the court's information management can be further regulated by setting up and promoting the unitary platform of electronic service all over the country,accurately choosing and applying specific serving techniques,and allocating full-time staff for electronic service.Apart from these aspects,supporting measures,such as promoting the participation of lawyer's firms and practitioners,enhancing the judicial publicity of the modes of electronic service,should be taken.The system of electronic service in civil litigation of our country is sure to be optimized gradually,which is very important to improve the system of service in civil litigation and eliminate the court's difficulty of service.
