Research On The Chinese Civil Case Guidance System

In November 26,2010,the Supreme People's Court issued the "Regulations" on case guidance,case guidance system in China was formally established,the establishment of case guidance system is a necessary requirement to achieve judicial modernization in the new period.Under the premise of the correct understanding of the case guidance system,this article launches the research on the case guidance system,analyzes the existing problems,and hopes to promote the system to play better results.In addition to the conclusion,this paper consists of five parts.The first part is the basic problems of case guidance system.This paper expounds the process,effectiveness and function of the case guidance system.The second part is the comparison with the case,the United Kingdom and Germany as the object of comparison,in the view of comparative analysis of China's case guidance.The third part is a case study of the guiding case,for example,from the Chinese referee instrument network,then select the 10 judgment,the reasons for the analysis of the reasons for the judgment,analysis of the practice of civil case guidance system form.The fourth part analyzes the problems in the choice and establishment of the case guidance system in the following two aspects.The fifth part of the case from the expansion of scale,resume database,code case compiling procedure strengthening case application and legal control etc.put forward their countermeasures.In a word,there are still many obstacles to overcome,especially the problems in the construction of specific system,which need to be grasped and improved in practice.The establishment of this system in China judicial reform history wrote a thick and heavy in colours.
