Research On Food Safety Liability Compulsory Insurance

A wave of food safety incidents set off in 2008 has not yet subsided,food safety issues still plague national governance,so that people suffer.By the end of 2009,our country developed a "Food Safety Law",with the increasingly severe food security situation,in the year of 2014,this law had to be modified,to be added to food safety liability insurance system to solve food security issues.This shows,the severity of food safety issues and the urgency of governance,as well as trust from the national in the introduction of insurance mechanisms on food safety.Although food safety liability insurance to alleviate the food security status has some utility,but rely solely on food safety voluntary insurance liability insurance is not enough to comprehensivily and fully spread risk and victim prompt compensation as soon as possible,so we should carry out compulsory insurance on the in high-risk areas and high incidence of food.This paper mainly from four aspects,the first part is the outline of food safety compulsory insurance,such as a brief introduction of correlative concept,features,and functions of the theoretical basis;the second part is the enlightenments of foreign food safety liability insurance;the third part is the food safety responsibility compulsory insurance practice in our country as well as the necessity analysis to carry liability compulsory insurance in our country;the fourth is the most important part of this paper,namely food safety liability compulsory insurance system specific building.Legally,we need to modify the "Food Safety Law",so that food safety liability compulsory insurance system is included into law,in the same time suggest State council formulates "food safety liability compulsory insurance regulations" as the basis for the specific operation by the relevant departments of the State Council;the main system contents including insurance principles,insurance their main rights and obligations,the subject matter insured,the premium rate,disclaimers,compensation range;supporting measures,mainly in the national response to food safety liability compulsory insurance underwriting insurance company to be tax incentives,initiated the establishment of food safety and liability insurance fund plus great for improving food safety and food safety awareness liability compulsory insurance of propaganda.I expect more than content with the feasibility of a series of adverse consequences for food safety issues brought to play a certain effect.
