Research On The Legal Relationship Between Taxi Driver And Taxi Company

In the past few years,China has experienced a significant development in economy and society,the taxi industry has received more attention.The development of taxi industry is related to the development level of the whole city.But in recent years the taxi industry has shown many problems such as the taxi drivers' strikes,"black car" to seize the taxi market,the appearance of new taxi app and so on which damaged the interests of the taxi drivers.The reason of the phenomenon is that the relationship between taxi drivers and their companies is not clear.What the relationship between the taxi driver and the taxi company is.China's civil law,labor law,labor contract law and other relevant laws on the taxi industry labor management are not clearly defined,resulting in different understanding of judicial practice,local labor Dispute Arbitration Court,the court ruling is inconsistent.Therefore,it is very important to clarify the labor relationship between the taxi driver and the taxi company,and then to protect the legitimate rights and interests of taxi drivers,to promote the healthy development of the industry.This paper combines theory with practice analyzes the legal relationship between taxi drivers and taxi companies by literature research and Empirical Research(interviews and case studies).The article is divided into five chapters.The first chapter mainly introduces the background and purpose of the research,summarizes the research results of scholars,and puts forward the research train of thought and research method,and gives the technology roadmap.The second chapter,from the theoretical point of view,puts forward the theoretical basis for the legal relationship between taxi drivers and taxi companies in China and provide a theoretical basis for the next chapter.The third chapter analyzes the legal relationship between taxi drivers and taxi companies in different business models based on the theoretical basis of the legal relationship between taxi drivers and taxi companies and the particularity of the taxi industry.The fourth chapter,from the relevant laws and regulations of the taxi industry in China,and empirically studies the status of labor relations between taxi drivers and taxi companies,finds out the problems.The fifth chapter,based on the foregoing analysis,based on the existing laws and regulations,theoretical status and the problems found in the field investigation of taxi industry,puts forward suggestions for improving the labor relations and legal regulation between taxi companies and taxi drivers.
