Research On The Influence Of The Construction Contract To The Result Of The Dispute Resolution Based On The Arbitration Cases

As one of the important factors that affects the success of the construction project,the construction project dispute has attracted much attention of researchers and practitioners.However,the research on the results of the dispute resolution has yet to be further studied.This paper examines the completeness of the contract terms and the level of the contractor's administration on the results of the contractor's dispute resolution in the construction project.On studying the results of contractor's dispute resolution,the proportion of the arbitration award obtained by the contractor in the arbitration shall be used as a proxy variable,at the same time,the completeness of the contract terms is divided into two dimensions,respectively test the influence of the completeness of the contract control terms and contract coordination terms signed by the contractor on the proportion of the contractor's award from the arbitration,and testing the level of the contractor's administration for the interaction of contractors to gain support for the proportion of the arbitration award.Through studying the 106 adjudication construction cases occurred in the arbitration commission in the northern city of China,,the results show that both the completeness of the contract terms and the level of the contractors' administration have positive influence to the successful claim of contractor,and the interaction effect is interference.Although the conclusions obtained in this thesis is that integrity of the completeness of the contract terms and the level of the contractor's administration on the results of the contractor's dispute resolution showing interference interaction,but the conclusion is only for one using arbitration as resolution of the dispute,besides the construction project time span is very long,considering the project life cycle,people should not only strive to sign a better contract,but also take efforts to administer the contract in order to achieve the ultimate success of the project.The conclusion of this thesis can help researchers to understand the integrity of the signed contract terms deeply,at the same time,it helps to arouse the engineering practice of personnel for the signing of the contract and pay attention to the stage of the contract administration.The research of this paper deepens the understanding of the influence of construction contract and dispute resolution,and also has certain guiding significance for the practice of how to get better results in construction arbitration.
