Studay Of Laws Against Unfair Network Competition

Nowadays,in our daily life,the network in everywhere,which brings great convenience to our life,and people also have a strong dependence on it.In the network enterprise,the number of users,the user's stickiness and the customer flow are the key to the profit of the enterprise,so some enterprises use the new network technology to carry out unfair competition behaviors and illegally obtain or utilize the users of other enterprises.However,due to China's old anti-unfair competition legal time network is still in its initial stage,legislators can not anticipate the current situation in the Internet market,and the lack of professional knowledge of judges in the Internet makes the court appear to be in a tight position in the face of such unfair competition.In order to solve the above problems,the new anti-unfair competition law was amended and adopted at the thirtieth session of the standing committee of the 12 th National People's Congress on November 4,2017,and stipulated in article 12 the act of unfair online competition.It is expected that the laws of the law would be a relief to the legal system of the Internet,but the other issues that have been dealt with in the executive and the courts of the administration and the courts have not been fully resolved.This paper introduces the concept and characteristics of network unfair competition behavior from the overview of network unfair competition behavior,and makes a distinction between the online unfair competition behavior and the unfair competition behavior of the network based on the new law's definition of unfair competition.On the basis of this,we can reveal the law and justice of our country in the past,when we were in the form of an unseemly,unjustified rivalry.Finally,by analyzing the specific characteristics of online unfair competition behaviors and combining with the actual situation,the author puts forward corresponding countermeasures to the difficulties encountered in the judicial and law-enforcement process,so as to improve the judicial and law enforcement level of the unfair competition behaviors of the regulation network,and bring into full play the effectiveness of judicial relief and administrative law enforcement.
