In the newly emerging network market,with the combination of the network technology and unfair competition,competitions together with the network features becomes more brutal,then new-typed unfair competition arise.The typical acts like malicious searching engine,network malicious link and so on.The current law is difficult to effectively curb the emerging issues,which bring the hidden danger to the healthy development of the network market.The legal office of the state council published<Anti-unfair competition law of the People’s Republic of China(revised draft)>in 25th February,2016,which stipulated new-typed network unfair competition in the form of list in article 13.This article begins with the summary of the new-typed network unfair competition,indicating the differences between the traditional network unfair competition,the new-typed network unfair competition and network technology innovation,in order to enable the readers to have an accurate grasp of the new-typed network unfair competition.There are a lot of new-typed network unfair competitions,such as the malicious searching engine,the network malicious link and the malicious software,revealing our laws exist in the regulation of the new-typed network unfair competition,such as the rough methods,the ambiguous concepts,the low compensation standard,the confused law systems.Then we should amend Anti-unfair competition law of the People’s Republic of China(revised draft)accordingly,raise the level of the judicial and law enforcement,play the role of the judicial relief and the administrative law enforcement,by the introduction of the foreign relevant legal system.
