Legal Protection Of Real Estate Investment Trust Individual Investors

In recent years,with the rapid development of China's social economy,real estate investment trust as an effective investment method in real estate investment has been favored by a large number of individual investors.How to implement effective legal protection for individual investors is an important issue for real estate investment trusts.At present,China's real estate investment trust system is still not perfect.Compared with the mature real estate investment trust system in foreign countries or regions,China's real estate investment trust still has many deficiencies in the legal protection of individual investors.This paper presents an effective way to improve the legal protection of individual investors from multiple dimensions by enumerating and analyzing the inadequacies of China's current real estate investment trust system for individual investor legal protection,and drawing on the mature experience of real estate investment trusts in other countries or regions.This article consists of the following six parts:The first part is introduction,which introduces the research background,research significance,research content and research methods.The second part is the current situation and insufficiency of legal protection of individual investors in China's real estate investment trusts.This part first analyzes the legal protection of individual investors in the legal relationship of China's real estate investment trust.Then,on the basis of summarizing the ways of legal protection for individual investors in China's real estate investment trusts,the author analyzes the legal protection of individual investors in China's real estate investment trusts and their causes.The third part is the extraterritorial reference to the legal protection of individual investors in real estate investment trusts.This section summarizes some of the mature experiences in the protection of individual investors in real estate investment trusts in the United States,Japan,Singapore,and Hong Kong,and summarizes the implications of extraterritorial laws on the protection of individual investors in real estate investment trusts in China on the basis of comparative analysis..The fourth part is to improve the legislative protection of individual investors in real estate investment trusts.On the basis of the foregoing analysis,this section proposes the ways to protect the individual investors of real estate investment trusts in China from three dimensions:regulating the trustee's obligations,improving beneficiary rights,and formulating special laws for real estate investment trusts.The fifth part is to improve the supporting legal system for individual investor protection of real estate investment trusts.On the basis of the foregoing analysis,this section puts forward suggestions for perfecting the supervision system and supporting legal systems for the protection of individual investors in China's real estate investment trusts from two levels:a sound supervision system and a complete supporting taxation system.The sixth part is the conclusion,which summarizes the main content of the full text.
