The anti-monopoly law of People's Republic of China has been officially implemented since 2008,which has promoted the development of China's market economy.It has become a milestone in the process of reform of China's market economy.The system of business commitment is one of the highlights introduced by the anti-monopoly law.With the development of market economy,the form of monopoly is getting much more diversified.The characteristics of complexity and concealment of the monopoly are more obvious than before,which has increased the difficulty of anti-monopoly law enforcement.However,the traditional rigid method of anti-monopoly law has been unable to solve some anti-monopoly cases effectively and quickly.Under these circumstances,the commitment system arises.It has gradually become the mainstream method of enforcement of the anti-monopoly law abroad with the advantages of efficient enforcement and quick recovery.Because the anti-monopoly law of China has just established,compared with other countries,the system of business commitment of China still remains some problems to be analyzed and improved.This paper first discusses the basic concepts,characteristics and nature of the commitment system,explores the theoretical origin behind the system,and then analyses some problems existing in the commitment system in our country,such as the scope of application,the procedural system and the supporting system for protecting the legitimate rights and interests of consumers.And then the suggestions of perfecting the system of the undertakings' commitment are described,such as the scope of application is perfected,the main body of starting the procedure,public information publicity,protection of the legitimate rights and interests of the third parties,and the protection of the lawful rights and interests of the respondents are also suggested at last.
