On The Judicial Cognizance Of The Crime Of Duty Encroachment

Bribery refers to a crime which in order to seek illegitimate interests giving property to state personnel.Or in economic dealings,violate the state regulations,To give a large amount of property to the state staff.Or violate the state regulations,giving kickbacks and commissions to various state personnel.In the theoretical circles and judicial practice,there are some problems in the judicial determination of bribery crime as below: identification of the crime in order to seek illegitimate interests,the distinction between the crime and the unit bribery,the definition of the boundary between the accomplice of crime and the crime of introducing bribe.Because of the far-reaching impact of bribery,it is necessary to solve the above problems.In order to limit clearance bribery crime and related crimes in the judicial practice of this crime is qualitative.This paper is a case study based Master's Thesis.
