Bribery refers to a crime which in order to seek illegitimate interests giving property to state personnel.Or in economic dealings,violate the state regulations,To give a large amount of property to the state staff.Or violate the state regulations,giving kickbacks and commissions to various state personnel.In the theoretical circles and judicial practice,there are some problems in the judicial determination of bribery crime as below: identification of the crime in order to seek illegitimate interests,the distinction between the crime and the unit bribery,the definition of the boundary between the accomplice of crime and the crime of introducing bribe.Because of the far-reaching impact of bribery,it is necessary to solve the above problems.In order to limit clearance bribery crime and related crimes in the judicial practice of this crime is qualitative.This paper is a case study based Master's Thesis,describes from the following three aspects.The first part of this paper is the introduction of the case,and make a list of the three focus of controversy in this case.The second part of this paper is the comment of the case.In this part,the author firstly describes the judicial recognizance of bribery crime,followed by discussion of the judicial recognizance of the crime of introducing bribe.And then introduces the difference between the crime of bribery and the crime of bribery.the final analysis of the judicial determination of the crime of unit bribery,The third part of this paper is reflections and suggestions.Firstly,the paper summarizes the conclusions of the case;Secondly,the author makes a deep discussion on the boundary between the crime of bribery and the crime of introducing bribe in the theoretical circle and judicial practice.And then the introduction of the crime of bribery and the introduction of the crime of bribery.
