Faced with the increasingly severe harm of drug driving,learning from experience that the number of drunk driving cases in China drastically decreased after drunk driving was brought into the criminal law system,it is an effective means to punish drug driving behavior by putting the drug driving into the criminal law system.Principle of crime and punishment requires that crimes and penalties be stipulated by law,therefore,it is necessary to incorporate drug driving which will seriously endanger road traffic safety into the scope of criminal legislation.At the same time,many mature criminal legislation experiences abroad for drug driving behavior also provide us with reference.In general,putting the drug driving into the criminal law system is an inevitable trend.Demonstrating the legitimacy and necessity of drug driving into criminal punishment is a prerequisite for incorporating drug and driving into the criminal legislation system,and setting up reasonable standards for incrimination and defining the subjective mentality of drug-driving activists according to the characteristics and hazards of different types of drugs,is a requirement for putting the drug driving into the criminal law system.Through the demonstration that existing detection technology can accomplish basic tasks of screening and detecting drug driving,it shows that the poi soning and driving into the penalties is technologically feasible.By comparing the relationship of traffic crime,endangering public safety crime,dangerous driving with drug driving behavior,and studying the criminal charges and punishments after drug trafficking,I try to consider the conviction and sentencing of drug driving Within the scope of the crime of dangerous driving.
