In recent years,the popularity of motor vehicles and the reducing of drug cost.Two reasons lead to the cases were appearing "Hawthorn type effect" outbreak.Drug is a kind of illegal behavior,when the drug and driving a motor vehicle together,its severity is obvious,"drug driving fierce as a tiger" is not an alarmist.However,the current laws are related to the "poison driving" some macroscopic and principled regulations,specific provisions "poison driving less legal liability law".Level administrative law mainly from limited drug addicts for motor vehicle driving license and motor vehicle driving license cancellation two aspects to regulation "poison driving",not "poison driving behavior set strict punishment.In short,administrative law for " poison driving crackdown " is too small,cannot achieve the purpose of deterring drug drivers.Since the " Criminal Law Amendment eight " define " drunk driving " as a crime of dangerous driving,there is increasingly strong voice from the public to put the " drug driving " which as dangerous as " drunk driving " into the criminal law.If " drug driving " causes no harmful results,there is only administrative law to regulate it." Poison driving behavior is a problem facing all countries in the world to,many countries started very early on the research of the driving " poison ",inspects the practice of all countries in the world,most countries have put poison "drive" into the scope of criminal law regulation,and set the severe punishment.Is necessary to follow the practice of other countries will have to be a serious threat to the citizens' personal property safety "poison driving behavior into criminal law" regulation,the effective protection of the citizens' personal property safety.
