Research On The Effect Of The Optional Cancellation Right's Limitation By Conduct In Commission Contracts

This article takes the issue of the validity of the agreed restriction made by the parties on the discretionary termination in the commission contract as the research object,which is roughly divided into three parts.The first part is about the general theory on the validity of the agreed restriction on the discretionary termination in the commission contract and the commission contract.This part mainly includes the following aspects: the origin and development of the commission contract,the comparison of the legislations regarding the discretionary termination in the commission contract,and the clarification of the main concepts in this article.The second part follows the research path of categorized discussion on the validity of the agreed restriction on the discretionary termination in the commission contract.The legitimacy of this research method was fully proved by the analysis on the nature of the legislations regarding the discretionary termination of the commission contract and the development of the commission contract.The third part comes into the categorized discussions of the validity of agreed restrictions on discretionary termination in the commission contract,which will be explained in three aspects: the identification of categorized methods,the development of categorized results and the supplementation of categorized rules.
