A Research On The Protection Of The Rights Of The Subjects In Personal Credit Investigation

Since ancient times,Chinese people have been paid high attention to good credit.In modern society,personal credit has been an important reference to one's reputation.With the expansion of personal credit investigation,the public are paying more attention to its reference value and putting forward higher requirements for the protection of personal information.Development of credit reporting industry needs to protect the credit body.It is very necessary to protect the rights of credit body in every link of personal credit investigation.This will do great favor to the healthy development of credit reporting industry.In practice,it also exploses a series of problems and legal disputes because of inquirying without authority,wrong data,lacking the way to dissent,while personal credit system playing a positive role in the society.The efficiency of personal credit investigation conflicts with the protection of credit bodies' rights.Information security is the key field of a nation.How to solve the conflict between personal credit investigation and credit information protection prudently,and strike a balance between the two,is an important topic for credit reporting industry.The text is divided into four parts:The first part shows the current situation of personal credit system in our country.I try to illustrate the urgent demand for protection of credit body byanalyzing the history of China's personal credit system,laws and regulations for credit reporting industry and cases which relate to personal credit investigation.The second part focuses on the comparative analysis of Chinese and foreign personal credit registry pattern.I make an analysis on the difference of personal credit registry pattern between the United States,Europe,Japan by contrasting their credit bureau,sources of personal credit data and legal regulatory framework.Then I put forward to the suitable personal credit registry pattern for our country that is to switch rules in different stages of development.In the third part,I make suggestions to the protection of credit body by the lights of other countries' laws for the right of credit.First,by summarizing the specific rights of credit body,I make a conclusion that the right of credit is not regarded as an independent right in China.Then,by analyzing the direct protection and indirect protection of right of credit,I find out whether right of credit is regarded as an independent right in other countries and regions.Next,I try to find out the legal attribute of the right of credit by analyzing three theories' attitudes.Finally,I make suggestions to the protection of credit body by the lights of other countries' laws for China's specific conditions.
