Internet financing is a new financing model developed based on emerging Internet technologies such as big data,cloud computing,and online payment,through online and offline docking,utilizing its own characteristics of decentralization,microfinance,equivalency,and demediating,it meets the needs of the general public and companies for financing and investment,and is gradually receiving attention from people and the industry.These internet financing businesses are intertwined and mixed in projects and industries.They are also constantly innovating in the application of network technologies.In addition,ordinary people have never been exposed to such projects before,making them more risky than traditional financing.Ezubao,loan-loan,Pan-Asia Group and other highly influential cases not only triggered our thinking on the problems existing in China's current Internet financing industry.The risks and exposed problems in China's Internet financing business are very national.They are closely related to the background of the social environment in which China is currently located.At the same time,there are some differences with the current situation in other countries.Through the analysis of the status quo of China's Internet financing and related cases,the author believes that in the current environment,China's Internet financing mainly has four major problems: improper prevention and control of risks,lagging legislation,inadequate participation of participating parties,and inadequate safeguards.In response to these problems,while combining a large number of case studies,the author drew on solutions from developed countries such as the United States,Britain,and Japan,and put forward his own proposals on how to solve these major problems and improve China's Internet financing legal regulations.We hope to provide ideas for the further improvement of China's Internet financing legal regulations.
