A Study On The Application Of Criminal Law In Song' Solicitation Of Murder

The number of murder-for-hire is rising along with the deepening social reform and the continuous development of market economy recently.These kinds of cases have the characteristics of participation in large numbers,complicated crime plots and association with multiple crimes,which are more complicated than other ordinary criminal offenses.Due to the complexity of these crimes,the final judgment is always a challenging task.Therefore,this study chooses this typical "Song' Solicitation of Murder" for the detailed analysis of contract killing.This case-analyzing thesis is about 26,000 words,adopts the "total-divided" structure and consists of five chapters,including the introduction and the conclusion.The first chapter describes of the case and its critical points.In the following chapters,the thesis first focuses on the murder Wang's crimes,sentencing and convicting,and then concentrates on the crimes of the person who hired him,Song.The introduction describes the current situation of contract killing in China,the characteristics of these crimes and the needs to prevent such crimes.Chapter One describes the details of this case,including how the case happened and the prosecution and defense of the two sides,and then extracts the main points of the case.Chapter Two discusses the legislation mode of the criminal law in China,the meaning of "successful" of a crime,the method of judging a crime,and concludes that Wang has been convicted of a crime.Chapter Three reviews the four aspects of the discontinuance of a crime and discusses the appropriate method of "automatic" judgment,and concludes that Wang gave up shooting the victim,leading to the end of the attempted murder.Chapter Four discusses the basis of the judgment of the plural of behavior,and concludes that Wang is guilty of three crimes and should be punished for his explosives charges.Chapter Five analyzes the conviction of contract killing in three situations,the meaning "the instigated person is not guilty of aiding and abetting",thus concludes that Song has been convicted of the explosive crime and should not apply the provisions of the 29 th of the criminal law to lighten or reduce the punishment.The Conclusion is a brief summarize of the full text.
