With the globalization of the world economy and the rapid development of knowledge and science and technology,countries are required to strengthen the protection of intellectual property borders.In order to reduce the barriers to intellectual property in international trade,the TRIPs Agreement pioneered the enforcement of intellectual property borders and protected intellectual property rights while ensuring that law enforcement will not become a legal obstacle to trade.China is a member of the WTO.It is also legally binding by the TRIPs agreement.However,developed countries are not satisfied with this.Although the ACTA,TPP negotiations,the EU,the United States and other major participating economies have not ratified the entry into force of the agreement,the agreement has revealed stricter requirements for border enforcement.Reflects the International Development trend of intellectual property border enforcement.China's rapid economic development,the expansion of the international market is an inevitable trend,through theoretical research,comparative analysis and other methods,in order to improve China's intellectual property border enforcement proposals.This article mainly consists of five parts: the first part is an overview of intellectual property border enforcement,including the origin and concept of border enforcement,the evolution of intellectual property border enforcement in the International Development,and the significance of intellectual property border enforcement.The second part expounds the border enforcement provisions in the TRIPs agreement,and carries out a detailed analysis from three aspects: the object of protection,the execution procedure,and the protection model of border enforcement.The last two parts are based on our country,first briefly expound our country intellectual property border law enforcement outline,and then through the TRIPs agreement detailed comparison analysis,summarized the similarities and differences and shortcomings,and then put forward the corresponding reasonable suggestions for the improvement of our country's intellectual property border law enforcement system.
