Analyses Of Legal Issues On Regulating Internet Chauffeured Car Services In China

Internet chauffeured car services has developed at an exponential rate because it can alleviate the traffic congestion and meet the customers’ travel demands by providing them with a more comfortable and rapid trip.The development of the chauffeured cars has cut the m arket share of the taxi industry,causing strong dissatisfaction and protests among the taxi industry and its drivers.As the pioneer of the sharing economy,Internet chauffeured car services carry itself with great social and economic benefits,yet it is difficult to regulate under the law system in china before enacting the Interim Regulations for Internet Chauffeured Car Services(IRICCS).IRICCS has legalized the Internet chauffeured car services,there still exist problems in the regulators’ idea,regulat ion mode,the regulation legislat ion and system.The study and analysis of the legal issues contributes to the improvement in the design of regulation system.The paper first gives the definition of the Internet chauffeured car services,compares the differences between the Internet chauffeured car service industry and traditional taxi industry and introduces the present situation of its development.Based on the IRICCS and its implement in other cit ies,the paper analyzes the present situation of regulating the Internet chauffeured car services and the administrative licensing-oriented regulating system.Then the paper analyzes the legal issues and reasons of causing these legal issues in the regulation of the Internet chauffeured car services in terms of the idea,framework and mechanism of regulating Internet chauffeured car services.Finally some suggestions are given for the improvement of regulating the Internet chauffeured car services so that policy makers and regulators can refer to.
