As the rapid development of economic since the reform and open-up policies, it's the most important basic to maintain the stability and harmony of labor relations. Labor relations is unbalancing itself, which makes employees in a passive and weak position. Chinese collective negotiation system was arising at the historic moment. The negotiation between Employee representatives and employer representatives about employee salary, working condition, labor insurance on equal terms. They make a collective contract according to the negotiation. But it seems to be not working.The collective negotiation system learns from the collective bargaining system which emerges in eastern countries. The labor relation is mediated by the collective bargaining system in many European countries. As for different national conditions, the collective bargaining system is different.Chinese laborers go out on strike frequently in 2014. The reasons for strike reflect laborers' weak position. Lack of legal function leads to labourers' strike and laborers guard their rights by stop working. It's a must to coordinate the labor relations and improve the collective negotiation system. There are some disadvantages in running the system, such as shortage of legal system, the missing of trade union function and less standard form of collective contract.The paper clarifies concepts of the collective negotiation system and analyzes the collective bargaining system. The paper aims to study improving the collective negotiation system based on the status quo.
