International organization for economic co-operation and development once published a report about the work time of all countries in 2011.It pointed out that China's paid work time is in third place of all the countries.Even more,it is reported that C hina has become one of the countries with longest work time and surpassed South Korea and Japan.The guardian,a British newspaper,reported in 2015 that the average working time of C hinese laborers is 2000 to 2200 hours,while it is only 1677 hours in British.My friend had told me that they often worked overtime to ten o'clock till the next day.The phenomenon of work overtime is common in today's China.With the Labor Contract Law and the Mediation and Arbitration of Labor Disputes Law passed in 2008 paying more attention to the protection of workers rights,the consciousness of workers taking law as the weapon to maintain their own rights and interests has become more and more intense.Contradiction between the labor and the capital accumulated in a long period of time presents a phenomenon of blowout.Labor remuneration accounts for the highest among all the contradictions,while overtime disputes takes up the highest proportion in the labor remuneration.There are a number of laws and regulations to protect the overtime work rights and interests of workers,but by interviews and referring to the r uling clerical of arbitration of area A in 2014,the author found that the number of overtime disputes is on the rise,it is hard for the laborers to win in the overtime disputes ruling,the overtime work rights and interests of workers are not well protected.Through the analysis of the problem,the author puts forward the overtime disputes prevention mechanism.That is,enterprises,workers and government work together to reduce the occurrence of overtime disputes,in order to promote the harmonious and s table labor relations.
