| Work-related injury insurance,closely related with the basic rights and benefits of thousands of workers,plays an important role in improving people's lives,developing economy and maintaining social stability.As one of the social insurances,work-related injury insurance is different from commercial insurance mostly in that the former aims at protecting the society's public interest by social redistribution of the insurance fund to help all social members.Work-related injury insurance is an essential and critical component of social insurance system,with the function of preventing and dispersing risk.The legal system of work-related injury insurance dates back to the 18th century and now has become very complete.However,China's legal system of work-related injury insurance was not established until the country's foundation in 1949.It is relatively complete but still has lots of problems awaiting solutions.This thesis finds out the main problems impeding the development of work-related injury insurance in China by reviewing its existing problems during these years,in order to improve and perfect our country's work-related injury insurance by learning from the experience based on foreign work-related injury insurance systems.The main problems in the practice of work-related injury insurance in China include:low coverage rate,difficulty in applying law rules in affirming work-related injury,irrational proportions of the insurance benefits,difficulty in realizing the rights,insufficient function of preventive mechanism of work-related injury,and lack of rehabilitation mechanism.Therefore,the author puts forward some suggestions on perfecting China's current work-related injury insurance system,such as,improving the legislation of work-related injury insurance,establishing a scientific coverage system,perfecting affirmation system,improving compensation procedure and standards of work-related injury,reinforcing preventive and rehabilitation mechanism of work-related injury,etc. |
