The Chinese Basketball Association Disciplinary Punishment System Research

In this paper,according to the actual circumstance of the development of the Chinese basketball association(CBA),using the methods of the documentary,logic analysis,the study of CBA disciplinary punishment system.Aimed at analyzing the problems existing in the current system of disciplinary action of CBA;so as to put forward relevant Suggestions.CBA disciplinary action system,mainly scattered in The Articles Of Association of CBA and other relevant regulatory documents,file for CBA internal power of institutions and stipulates the relief agencies.After an investigation,the writer sums up out of CBA disciplinary action procedure.Disciplinary action system of CBA mainly three problems: lack content penalty system;Punishment procedures need to join the hearing system;Penalty execution time scale.The reasons for these problems lie in the fact that the relative rights and obligations of CBA are not equal;The autonomous mode of good basketball field is not mature;The lack of management in accordance with the environment.Reference domestic and international sports organization and management experience,CBA need to learn from NBA management experience and arbitration;FA hearing system Settings implementation experience and punishment procedures;CFA construction experience and the special committee hearing system implementation.The author suggested: in order to improve the system of disciplinary action of CBA,CBA represents the interests of all parties should be involved in punishment system formulated;Punishment to make a perfect program;Punishment mechanism to make unified;To provide judicial relief way;Construction of sports arbitration institutions in China.
