The Embodiment Of The Party’s Leadership In Journalism In Chinese Journalism Legislation

The state,the media and the citizen are the three main subjects in the news-disseminating activities.From the 80 s of last century,the study on the legislation of "press law" has become a hot topic in journalism.The study of the press law has always been focused on the press law and the citizen,that is,the micro level of the press law and the individual.However,there is little research on the press law and national macro level.In this paper,which recognize the relationship between the party’s leadership of the Journalism and the law of the press dialectically,in fact,Party leadership and news legislation complement each other.In the news legislation,how to regulate the news law,which can reflect the party’s leadership of the journalism and safeguard the appropriate freedom of the press for China’s national conditions It is the difficulty of our country’s legislation legislation and the focus of this paper.There are four parts in this paper.The first part dialectically analyzes the legitimacy of the party’s leadership in journalism.By analyzing the Constitution,to explain that adhering to the leadership of the party is an important content of the spirit of the Constitution and the leadership of the party to the journalism is recognized and guaranteed by the Constitution.However,the freedom of the press that adheres to the leadership of the Communist Party of China is an important prerequisite and political security.The second part analyses the relationship between the leadership of the party and the legislation of the press dialectically,which complement each other.The legislation of the press helps to strengthen the leadership of the party in the field of news propaganda,adhere to the correct guidance of public opinion.However,upholding and improving the leadership of the party is helpful to the legislation of the press to carry out the function of maintaining the public interest in the field of Journalism and communication.In addition,in the systematic review of the country since the founding of the news on the basis of legislation and by making a comparative analysis on the three draft of the draft law of the people’s Republic of China at the end of 1980 s,which points out the concrete manifestation of the party’s leadership in the draft law and the problems between the party’s leadership and the news legislation.The third part is a study on the legislation and cases of foreign countries that related news communication,which turns the perspective of the research abroad and has a comparative analysis of representative and typical socialist and capitalist countries in the legislation of the press.What is more,this part chooses the Yugoslavia,Romania,Vietnam,the United States,Britain,France,South Korea,the seven countries that related to the dissemination of legislation and cases as the object of study.Meanwhile,it is trying to get the experience that our country will draw lessons from and combining the relevant laws and regulations of foreign countries with the reality of our country.At the same time,it provides feasible suggestions for the legislation of the press in our country.The fourth part,which provides suggestions of the party’s leadership in the news legislation of our country.First of all,the basic principles of China’s news legislation are discussed,which are the principles of the country and the of principles moderate degree and puts forward some suggestions on how to embody the party’s leadership in the news legislation of our country.This paper mainly adopts comparative analysis method and has rational analysis of the process of China’s press law.It also launches research from the perspective of the relationship between the leadership of the party and the press law and explores the complementary relationship between public power and the freedom of the press.Meanwhile,this paper tries to provide references for the legislation of the China’s news and makes up for the vacancy of the research by analyzing the relationship between the balance of the power of the ruling party and the freedom of the press in foreign countries.
