The Research On The Supervision Of Social Insurance

The social insurance fund provides financial support to the career of social security in our country, supervision of the social insurance funds has been paid a lot of attention. However, the cases of social insurance fund still occur frequently. To supervise the social insurance fund can affects the public opinions, and as the government report has also made emphasis on the construction of social security system, the efforts to improve the social insurance fund supervision should be made as soon as possible.Inspired by the common problems in social security cases, this article found the problems in supervision including legal uncertainty, regulatory loopholes,subject deficiency, confused responsibility and low information transparency. As an important part of social supervision and regulation is vacant for a long time, it is difficult to take effect. The lack of independence of the government regulation, regulatory personnel quantity is less and the division of functions and powers is not clear make the administrative supervision inefficient. The lack of laws and regulations troubles the implementation of regulatory. Insufficient information disclosure reflects the lack of efficiency in the supervision and punishment which disturb the public convince. The reasons of problems before are self-supervision of government, improper design of management system and lax enforcement of the law. Lacking of independence, mistaken personnel appointment right and the right of direction can interpret those reasons.At last this paper gives some suggestion to improve the supervision,such as establishing a supervision outsourcing system, perfecting the information disclosure system and establishing the law enforcement responsibility system. Supervision of outsourcing system is the innovation of this paper, this system can ensure the independence of fund supervision and social supervision can expand the influence. Change of personnel appointment system, perfecting the information disclosure system can effectively reduce the excessive government intervention in the management of the fund. The implementation of the law enforcement responsibility system for the law gives full play to the supervisory role, deterring illegal behavior.
