Research On The Legal System Of Cultivated Land Pollution Control

Environmental legal issues are always problem-oriented and environmental damage is logically the starting point for the research of environmental laws.Soil pollution prevention and remediation is a heated topic in China.Soil is critical to sustain lives on Earth which is directly related to issues of agricultural development,basic ecosystem functions and food safety.In many types of land-use,the farmland plays a significant role,while it is directly related to national food safety.Due to the deficiency of the existing legal system,the liability of farmland pollution remediation is difficult to achieve,and the local government is also facing a shortage of available funds and other realistic issues.The article combined with the special circumstances of farmland pollution,aiming to improve the remediation legal system of farmland pollution.This article is roughly structured as follows:The first chapter is mainly about existing environmental laws and regulations which is the basic need for analyzing the existing system and norms related to farmland pollution.Documents include ratified Conventions,national legislation,local legislation and national policies which are relevant to farmland pollution.Dynamically,here analyzes the establishment of regulations and summarizes the obstacles.The second chapter summarizes the existing shortage of farmland pollution legal system and analyzes the reasons.With practical examples,here summarizes the existence defects of farmland pollution institutional governance liability and it's lack of supporting systems such as quality standards system,farmland pollution control system,financing system and other issues.Here also analyzes how the deficiencies come,placing particular emphasis on pollution sources and the main structure types.Listing different farmland pollution types leads to different pollution liability relations,so it may provide the foundation for analysis.The third chapter,as the core farmland pollution liability system,firstly determines the basic principle of the polluter pays principle.Here analyzes different model Polluter Pays Principle and it's evolution.The experience of soil pollution remediation in EU is under the guidance of Polluter Pays Principle.Combined with China's farmland pollution peculiarity,learning from Japanese's experience of farmland pollution liability regime,here puts forward an ideal farmland pollution liability regime,exploring the implementation mechanisms.The fourth chapter proposes concrete ideas about the supporting regimes.Based on the comparison and reference of international pollution remediation experiences,here proposes to build the farmland quality standard system,fund-raising system and distinctive regulation method of the pollution-control system.
