China's Research On Climate Change Legislation

In today's society,with the increase of population,the rapid development of industry and the automation of agriculture,the impact of mankind on climate is also gradually expanding.People enjoy the fruits of transforming nature to meet their own needs and suffer from extreme weather such as destruction of nature,global warming,and even droughts,floods,haze and hurricanes.The issue of climate change has aroused global concern and tackling climate change is also an international problem,in which case we need to regulate the law,build and perfect the legal system to deal with climate change,balance the relationship between human development and climate change through the intervention of law,and make the development sustainable.Although China's attitude towards climate change is positive but its legal system has been delayed,there are many problems,such as imperfect legal system,lack of special legislation to deal with climate change,imperfect legal system,defects in legal management and liability system.Therefore,to strengthen the study of climate change legislation not only makes the international treaties already signed and the international commitments already made,but also has the very urgent practical significance for us to deal with the relationship between human and environment,to improve production life and even economic sustainable development.This paper mainly from the causes of climate change and the harm caused by the start,this paper probes into the current legislation and existing problems of climate change in China,and tries to put forward some suggestions on how to deal with climate change by referring to the typical representative of the United States and the "special type" legislation in dealing with the "fusion type" of climate change.The article is divided into four parts:the first part describes the main causes of climate change,secondary reasons,and through authoritative data to show the performance and harm of climate change.It is suggested that the cause of climate change is very complex,and the influence of the long term and long-term characteristics,the mitigation of climate change and adaptation of climate change will inevitably be a complex and lengthy process,ultimately need to form a long-term mechanism to adjust and standardize the law;The second part expounds the present situation of China's legislation to deal with climate change,and deeply analyzes the problems such as the imperfect legal system,the lack of special legislation to deal with climate change,the imperfect legal system,the defects of legal management and the system of responsibility;The third part elaborated the international law to deal with climate change the summary,and in the United States,the United Kingdom two typical different processing way country For example,analyzes compares,proposes the experience to draw lessons from;The Forth part is on the basis of relevant theories and experiences,and puts forward the legislative suggestions to China to deal with climate change.
