Improve The Research On China's New Rural Cooperative Medical Security System

The issue about farmers' health is closely linked to the national economic development and social stability for the continuation of the agricultural civilization.Along with the disintegration of the old-type rural cooperative medical system and the promotion of reform and opening,the new-type rural cooperative medical system has taken effect since 2003.The new-type rural cooperative medical system is an interdependent system for the health of the farmers established by raising fund through multiple channels and accepting the government's support.Social Insurance law,which had been enacted in 2011,dictates the new-type rural cooperative medical system,but beyond that,there is no systematic legislation for protecting farmers rights and affirming the duty bearers.The role of government is limited to offering subsidies and supervising the system operation,but without coming to the point of farmers' health problem."What's the legal nature about the new-type rural cooperative medical system?Has any defects?How to getting improvement and perfection?".The thesis is to discuss and solve these issues.From the point of social efficacy,the thesis is aimed at analyzing the welfare and barrier in the background of the new-type rural cooperative medical system,wth the study methods including concept analysis,difference analysis,example analysis and so on.Then,trying to make efforts to improve the system for giving better service for farmers.The subject of this thesis consists of four parts.The first part is a general overview of the new-type rural cooperative medical system.Firstly,briefly introduce the development process of the system,explain the difference between the new and the old one,analysis the present situation of the new system.Secondly,analysis the nature of the system from the perspective of the constitution,introduce the policies and regulations of the state council,ministries and regional government,then determine a definition for the new system.The second part,this thesis takes the new-type rural cooperative medical system which has been implemented in DongTai in JiangSu province as a representative example.By taking the field investigation,summarizing experience of the example,and finding the existing problems,this part is trying to design the rational legal system for the development of the new-type rural cooperative medical system.In the third part,is to analyze the deviation and defect of the new-type rural cooperative medical system in the level of theoretical design and practical operation.Find out the problems in the practice.Regarding the human rights,personal rights,and the rights for health as key points,analyzing the reasonability of the system from the perspective of rights protection and fair justice.analyzing the validity of the system from farmers' legal protection and governmental responsibility.The fourth part puts forward some suggestions on promoting the new-type rural cooperative medical system,including legislation safeguard,conceive of legal system,defining government responsibility and stretching the boundary of public benefit activities.
