On The Right To Take Back The Bankruptcy Compensation

The right of retrieval is important in the law of bankruptcy, among the property which debtor in possession of, some of them are not belong to the debtor, which may belong to third party, and so we have the right of retrieval to protect the property of third party from the bankruptcy. There are the general recall right, the right of retrieval for compensation, the seller recall right, and the trading-trust recall right. Most of them have already had the detailed rules in both the law and the theory, but for the recall right of compensation, there's a little rules, so as in the theory. We only can see it in some teaching materials. So I write this paper, try to find the connection in theory between the recall right of compensation and the traditional civil law, and analysis the basic construction of the right of retrieval for compensation.
