Research On Food Safety Compulsory Liability Insurance System

With the improvement of socio-economic, the issues of food safety have become more and more seriously. The frequent food safety accidents not only harm the interests of many consumers, but also affect the healthy development of the food industry. Insurance has the role of risk diversification and making up for the loss. The implementation of compulsory liability insurance in food industry can effectively reduce the incidence of food safety accident and protect the legitimate rights and interests of consumers. Therefore, it has far-reaching significance for maintaining social harmony and stability.This paper introduces the basic concepts of food safety and compulsory liability insurance, followed by the introduction of the worth of mandatory food safety liability insurance and the analysis of foreign food safety liability insurance. Finally, it proposes the design of construction of mandatory liability insurance of food safety in China.This paper is divided into three parts:In the first part, it is an overview of the food safety system of compulsory liability insurance theory from the perspective of the defining of the liability insurance, compulsory liability insurance, and compulsory liability insurance of food safety.For example, followed by the describing of the importance of food safety mandatory liability insurance.In the second part, it introduces the basic content of food safety liability insurance in the United States, European Union and Chinese Taiwan, and then it sums up the important revelation to improve our food safety liability insurance by analysis and comparison.In the third part, firstly the law current situation and the trying work of China's food safety liability insurance are analyzed; finally makes recommendations for the improvement of mandatory liability insurance of food safety from the aspects of its business model, the main legal relationship of insurance, the scope of the insurer's liability, rate setting and regulatory relief.
