On The Path Choice Of The Theory Of Criminal Constitution In China

After the introduction from Soviet Union at 1950 s, Chinese theories of crime composition have experienced several periods: the nihility period during 1957 to 1976, the ice-breaking period from the Third Plenary Session of the11 th Central Committee to 1990 s. Since 1990 s, crime composition gradually changed to topic of scientific research and appear into the perspective of the criminal law. After the baptism of the new millennium, crime composition has become a hot research topic of criminal law. At the same time, “question” and “response” about crime composition have never stopped.At first, we analyze the domestic and foreign developments of crime composition, and show the viewpoints, debates of domestic researchers. Then we try to build the value orientation which followed by crime composition theory. At last, we show superiority of the Continental Law System Crime composition theories.the theorical and practical bases for the introduction of these theories is also illustrated. We hope our research works in this paper will generate some contributions to the Criminal Law.
