Disputes And Solutions To The Drunk Driving Case

The promulgation of the Judicial Interpretations on Drunk Driving has helped alleviate the dilemma of the "lack of adequate rules" upon the "prescription of drunk driving in the Criminal Law". However,due to a rather conservative attitude of pertinent organs and the limited room for formulating new rules,this Interpretation can hardly resolve all problems arising from the current practice of coping with drunk driving cases. It is imperative that current laws be modified or new judicial interpretations be introduced to further improve rules on drunk driving cases from the following aspects, such as to take measures against impeding alcohol testing, to improve the criterion for identifying drunk driving behaviors,to clarify the application method of Article 13 of the Criminal Law and to specify conditions for application of probation.
