The Change Of Sandu Aquarium's Customary Law And Its Dispute Resolution Research

In the long-term development of history,each ethnic group has its own unique customary laws due to its own characteristics of geography,economy,culture and other factors.These customary laws play an important role in minority people's daily life and make a great difference on their history development.Affected by social development,national fusion,and contemporary national legal system construction,the contents of minority customary laws have been changed dramatically,which makes themselves conflict with national law in the dispute settlement of minority administrative regions.This paper analyzes Sandu Shui Minority Autonomous County's customary law in Guizhou province.It aims to figure out Sandu Shui Minority customary law's developments and changes in Shui social development through the study;And it is searching for Shui minority customary law's function on the dispute settlement and finds its own way for future development in Shui minority administrative region;Also,it puts forward some advices according to the insufficiency of Shui minority customary law,expecting that it can help the study for Shui minority customary law and the legal system construction.This paper is consisting of four parts except for introduction and conclusion: The first part mainly introduces the situation of Sandu Shui minority,the basic concept of Shui minority customary law,and the reasons why Shui minority customary law can be reserved nowadays.;The second part mainly narrates Shui minority traditional social organization,the customary law about civil affairs and criminal affairs,and whose reasons for change and their present situation;The third part focuses on analyzing the impact of Shui minority customary law on dispute settlement,and the insufficiency of the customary law;The fourth part offers some guidance and advice to Shui minority customary law in settling dispute,which looks forward to playing an active role in the legal system construction in Shui minority administrative region.
