On The Breakthrough Of The "bottleneck" Of Civil Delivery In China

In the civil procedure,service is an important bridge which connects the entity and procedures,and an integral behavior element in the entire civil procedure process;it occupies nearly 50%of the judicial resources of the civil trial system,but the system for such the significant role is not seen as sufficiently important,"service difficulty" is an adverse factor which always troubles the judicial trial work,and causes excessive judicial resource waste and low judicial trial efficiency.Compared with several tens of regulations on the service system in foreign laws,there are only 9 articles on servicein Civil Procedure Law of the People's Republic of China.For quite a long time,service is only considered as a pure procedural and technical issue but on the edge of judicial reform and theoretical study;the study on the civil procedure servicesystem is not a hot study point in thefield of jurisprudence,there are few specific works on China's civil procedure servicesystem;the specialized comments on China's civil procedure servicesystem explicitly expounds on China's civil procedure servicesystem and issues,and most of them perfect the service modes in terms of functions and structures within the set legal framework,but seldom make in-depth discussion about the reasons for the issue of "service difficulty" which is still in existence,and the "service difficulty" still restrains courts' normal processing of civil trial work.The paper plans to base on the current civil service system,emphatically analyze the reason for the issue of "service difficulty" through concept analysis and empirical analysis,targetedly raise solutions for the system defects in the related fields(including population management,market subject governance,etc.),reduce the occurrence of factors which hinder judicial service through improving systems,and hopes to find both temporary and permanent solutions for the issue of "service difficulty" in the field of civil service.
