Research On Administrative Law Protection Of Personal Information

Personal information except for commercial use,can also provide a basis for government decision-making and so on.But plays an important role in personal information,personal information by the case of more and more,personal information security has received the serious threat,now has become a common concern of the personal information protection.Personal information based on the concept of administrative act defines as the foundation,and category of administrative law of the state organs and state organ violations of personal information to the study on and form,and then find out the existing problems of our country administrative law protection of personal information,at the same time to the improvement of the administrative law protection of personal information about system put forward the corresponding countermeasures.In this paper,the body of the department is made up of four parts.The first part,first of all define the concept of administrative law protection of personal information,and then discussed the significance of administrative protection of personal information and content.The second part,mainly based on the United States and the European Union to study two kinds of comparatively typical legislation pattern,and put forward the model of merit for the enlightenment of our country.The third part,from the present legislation in our country administrative law protection of personal information,personal information rights violations of expression,the problem of administrative law protection of personal information in our country,these three aspects,summarizes the main information rights for violation of two kinds of main types,namely the state organs and state organ,this paper expounds some problems existing in the administrative law to protect personal information.The fourth part,in view of the personal information protection in the aspect of policy and law and related procedures several measures are put forward.
