UK Public Charitable Donation System Research

Public charitable collections is a behavior performed by charity organizations with a charitable purpose to call for public donations from the whole society.It is also a major financial resource for charity organizations.There are different rules and regulations among different countries for standardizing the public charitable collections activities and permitting to aquire public fund-raising qualification.UK is known as the first country publishing the Charity Act in written form all over the world,and its law system for public charitable collections has been completed as time goes by.Before the Charities Act 2006 in UK had being issued,UK lacked of unified charitable collections law system so that local regulations or practices for charitable collections were diversified.The local governments of UK who have made a lot of efforts have provided experience and laid solid foundations for the unified public charitable collections system in UK in 2006.It is no doubt that the Charities Act 2006 in UK is a great progress for the public charitable collections system.In this law,various new regulations appeared on the historical stage,and public charitable collections system could be one of the biggest highlights.In 2006,the Charities Act in UK proposes the unified regulations and necessary limitations for the specific events of public charitable collections.In the year of 2011,the Charities Act in UK regarded the approval and licensing the public charitable collections certification as a basic function of Charity Commission.This essay can be divided into four parts.The first part is the introduction that introduces the topic choosing basis for the essay including the research current condition both at inland and abroad,the topic theories and practical significance.In the second part,it takes the historical process of UK public charitable collections system as entry,and analyzes the cause for the establishment of public charitable collections system in UK and the influences brought about by various factors at different stages on changing process of this system.For the third part,in terms of basic legal relationship and legal supervision relationship,it gives legal analysis on the current public charitable collections system in UK,and explores the value orientation of public charitable collections design of the UK legislators.By combining the inference from the second part,it concludes the causes for the progress of the UK public charitable collections system at current stage in terms of culture and system design.In the last part,based on the current condition and the problems existing in China' s public charitable collections,it analyzes the design for the public charitable collections system of the Charity Law of People's Republic of China,and gives comments.At the same time,taking examples of dual access mechanism,the regulation mechanism of Charity Commission,donation tax incentive mechanism and cy-pres doctrine in UK public charity donation system,it improves the China's public charitable collections system,including the combination of license system and filing system,strict access of subject qualification,improvement for tax incentive mechanism,establishment of specific charity regulation institution,strengthening of information publication system of charitable collections and extend the scope of the Cy-pres Doctrine.
