Traffic Accident Crime Research

Traffic accident crime is the new "criminal law" amendment in 1997,was formally identified as criminal charges.The original legislation is considered in recent years,driving a motor vehicle on the road traffic accident behavior shows the prone situation,seriously affect the stability and harmony of our society,threatening harm to society,people reflect strong.The occurrence of traffic accidents will endanger the land of the majoity of the people and property safety,but also to the community and the masses of the,health and proprty caused serious harm.Therefore,the crme of causing traffic casualties,should be punished according to law.The curent interpretion of "road traffic safety law" on the "road" is not clear of the traic accident crime puniment scope,the integrity of the constitution of this crime is destroyed in a certain extent,improper to reduce the traffic accident crime punishment scope,some will fully comply with the constitution of the crime to the behavior out of the traffic accident the crime,the punishment of the crime of criminal behavior is not conducive to the realization of the aim.At the same time,in the judicial prctice,the behavir of the traffic accident in the presence of intervention factors,the identification of the illegal nature of many difficult problems.To solve the above problems,this paper carefully analysis of traffic accident crime case study took place,on this charge,analyzes how to identify the influence factors involved in the traffic accident,how to distinguish the causal relationship between the traffic accident crime and the crime of negligence causing death in two aspects of problems,and one of the controversial and difficult problems are discussed and analysis,the author’s view.Hope in the practice,to solve the problems of such cases can have practical significance.
