Research On Compensation Mechanism For Collective Land And House Expropriation

With the rapid development of economy,the demand of construction land is increasing year by year.A great amount of agricultural land has been requisitioned,and many farmers have lost their land which make the life more difficult.Land expropriation refers that the national government transforms the collective land of the farmers into the state land for the public interest according to the legal procedures and approval authority after compensating the farmer groups or individuals.It is a common practice in the world to compensate the peasants who have been expropriated for public interests.However,the current land expropriation regulations in our country have obvious characteristics of planned economy.Therefore,it is necessary to study the existing problems of land expropriation compensation mechanism and put forward some countermeasures.According to the different type and characteristics of the expropriation compensation system caused by the different properties of the state land and collective land,integrating the policy theory research with my personal work,this article will start with the basic concept and theory of collective land and house collection compensation to summarize the concept and the included content of its mechanism,based on the comparative analyze of state land,collective land and house expropriation compensation system.Since I worked in towns or sub-district offices,I will take the collective land and house collection of a residents group in Qilin district Qujing city as an example to give a detailed introduction about the achievement,worthwhile experience and methods,existing problems and reasons of the collective land and house collection compensation work,deeply dissect its existing contradictions and further to clarify the core problems of the expropriation compensation mechanism.Owing to the lack of relevant laws,the imperfect compensation mechanism,not unified compensation system,low compensation standard and other factors,the existing collective land expropriation compensation mechanism can not be well adapted to the situation of our country and people,and to a large extent damaged the interests of farmers and collective economic organizations.Meanwhile,the situation of expropriation compensation work is more and more complicated.Under the influence of profit game,the government,collective economic organizations,relocatees,developers and other participant bodies are difficult to find corresponding regulations to follow.In America,Japan and other developed countries,because of the privatization of land,there is no collective land,but the experience of compensation mechanism and system is worth learning.At the same time,some developed areas in China also made some exploration and achieved great breakthrough.We urgently need to enrich and improve our expropriation compensation work from the legislation,system and mechanism to make it into systematism,scientization and equality.Combined above analyze and my work in grass-roots unit,this article put forward some recommendations about perfecting the collective land expropriation compensation mechanism and found some binding points between the practical work and its theoretical basis.I expect to make some contributions on the system and theory of expropriation compensation work.
