With the continuous development of commodity economy and the deepening of China's reform and opening up process, the civil law, international law to domestic law to transform into the characteristics of the times, which is derived from the law as the superstructure of the economic basis from the property.However, the system of prescription and limitation of action is considered to constitute a complete system of prescription in the sense of the traditional civil law, but the Chinese mainland has been introduced into our civil law so far, and has not recognized that the time can be used as a real right. Therefore, it is necessary for us to review the traditional system in the new historical period, and to seek a correct way to meet the "localization" of Chinese mainland on the basis of summarizing and drawing lessons from abroad.In this paper, we will mainly analyze the evolution process and the advantages and disadvantages of the time by comparing the research method and the literature research method.The first part of this paper mainly describes the writing background and purpose of this paper, and introduces the research status and the research methods of this paper.In the second part, the paper mainly expounds the emergence, evolution and the repeated process of the system of aging in ancient Rome, the twelve copper table method, the evolution of the country, and the legislative level in China.The third and fourth parts are the elements of the system, the value orientation and the use scope of the study, the system's independence and the value of the more objective review, seeking to obtain the universal value of prescription.The fifth part is based on the previous parts, the current situation and development trend of our country, from the legislative, judicial and special fields, and so on.
